IMPORTANT: READ CAREFULLY — THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS
I understand and acknowledge that participation in fitness activities, exercise programs, personal training, group classes, and the use of gym facilities and equipment involves inherent risks. These risks include, but are not limited to, bodily injury, muscle strains, sprains, broken bones, illness, heart attack, paralysis, or death. I voluntarily choose to participate and fully assume all such risks, whether known or unknown.
I represent that I am in good physical condition and have no medical condition that would prevent my safe participation. I acknowledge that it is my responsibility to consult with a physician prior to beginning any exercise program.
To the fullest extent permitted by California law, I hereby release, waive, discharge, and hold harmless Prodigy Combat Academy, its owners, officers, employees, agents, trainers, contractors, and affiliates from any and all claims, demands, damages, or causes of action arising out of or related to my participation or use of the facilities, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, except for gross negligence or willful misconduct.
I agree to indemnify and hold harmless Prodigy Combat Academy from any loss, liability, damage, or cost (including attorneys' fees) arising from my participation or violation of gym rules.
I agree to follow all posted rules, instructions, and safety guidelines. I understand that failure to comply may result in suspension or termination of my access or membership without refund.
I grant Prodigy Combat Academy permission to photograph or record me and use such images or recordings for lawful promotional purposes without compensation.
If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This agreement shall be governed by the laws of the State of California. Any legal action shall be brought in the county where Prodigy Combat Academy is located.
I acknowledge that I have read and understood this waiver and release. I understand that by agreeing, I am giving up certain legal rights, including the right to sue. I enter into this agreement freely and voluntarily.
